PRIVATE LABEL TERMS & CONDITIONS

American Watch Product,With Logo printed, Laser Engraving & Custom Packaging – Terms & Conditions

Please read these terms and conditions of use carefully before placing orders over the phone or using this site or before ordering any custom watch dial and laser engraved watches form us.

CUSTOM WATCHES – RETURN & REFUND POLICY

For American Logo Watch stock watches without your logos and designs.  We will accept a return within 10 days from the day of purchase with a 25% restocking fee for our stock watches only. All returns requires a Return Authorization Numbers and must be packed in the original package, unused. The watch must be returned to American Logo Watch within 10 business days of the issuance of the RAN.

*Please note American Logo Watch would not accept the return of the following watches/packeging:

1. Watches that are custom-configured to your specifications, including all custom dials, laser engraved and private label orders (including, packaging, logos, graphic design work, and any work that is specific to your company, brand, logo, graphics or anything provided to the customer from American Logo Watch that is tailored to your specs – including digital mockups.
2. Special Orders – packed to your individual specs that are not part of our normal stock product offerings and packaging.
3. Any custom packaging that we have printed your logo(s), or any other graphics that are specific to your business and not within our normal stock product offerings.

*The reason American Logo Watch does not allow returns for any custom engraved or private labeled watches is because there is extensive work that goes into getting the printing and engraving artwork ready once the order has been placed. As soon as you pay for your order in full, or pay any amount down as a deposit for a custom order (whether you are ordering from our website, or over the phone, emails, or in any other watch, American Logo Watch does not allow for any returns, refunds or exchanges because the watches that have been manufactured have your logo/artwork/graphics imprinted on them, and American Logo Watch cannot sell these products to anyone else but you or your company/brand. American Logo Watch also incurs significant costs and spends significant time on private labeled orders from the time your invoice is paid in full, or locked in with a deposit of any amount.  each customer is encouraged to read and understand them before placing and paying for any custom order(s).  American Logo Watch may have already started production on your order. Once this is done, again, we cannot sell these products to any other person, brand, or company which is why we do not allow refunds, returns, or exchanges on custom orders, unless there is an obvious defect in the product itself (see below for more details on this). “by paying in full, or any partial payment amount, you are agreeing to our Terms and Conditions for both stock and custom watches laser engraved”.

NOTE: American Logo Watch recommends that you (1) use a carrier that offers shipment tracking for all returns and (2) either insure your package for safe return to American Logo Watch or declare the full value of the shipment so that you are completely protected if the shipment is lost or damaged in transit. If you choose not to (1) use a carrier that offers tracking and (2) insure or declare the full value of the product, you will be responsible for any loss or damage to the product during shipping. Please note that the United States Postal Service (USPS) offers limited tracking capabilities and that there is a 30-calendar-day waiting period before the USPS will initiate a trace. SHIPPING OR FREIGHT CHARGE IS NON-REFUNDABLE

CANCELLATION

Order for stock items can be canceled up to 48 hours after your order has been placed as long as the item has not been packaged, crated and/ or shipped from our warehouse. Customized orders CANNOT be canceled once placed, there is no exception due to the nature and work involved in custom, private labeled orders.

CUSTOM CONFIGURED PRODUCT

We are pleased to offer watches which are custom configured to your specifications, and encourage you to review your order, including your digital mockups and invoice carefully. Since the product is created to your specifications, the order cannot be changed, modified or canceled once your order has been placed and either paid in full, or any deposit amount has been paid. We may start preparing the graphics for your order immediately after the invoice has been paid in full, or a deposit has been paid. We will then send digital mockups which require written approval from each customer before we send your order to mass production. However, there may have been significant time, costs, and expenses incurred by preparing your order for private labeling, including, but not limited to: graphic design, vectorizing your logo/artwork/design(s), invoicing, accounting, manufacturing blank Kashers, engraving part of your order that has written approval while waiting on final approval for another part (for example, we may have already printed or engraved your entire order after you have given written approval for the order.

SALES TAX

American Logo Watch will include sales tax based on the ship-to location and the sales tax rate in effect at the time of shipping. 

DELIVERY

BINDING AGREEMENT

By accessing and purchasing from our  website, paying or putting a deposit down on a custom watch face or laser engraved order, you agree that these Terms and Conditions form a binding agreement between you, and American Logo watch. If you do not wish to be bound by these Terms and Conditions, do not purchase products from our website or company. american Logo Watch reserves the right to change these Terms and Conditions at any time; However, if these terms and conditions are changed after you have placed your order, and before you receive your watches, the original copy of these terms and conditions will be the binding agreement held which you agree to by purchasing any product off of our website, . You should review these Terms and Conditions before placing any order(s) from American Logo Watch. Your use of our website, phone-in orders, orders placed , signifies that you agree to be bound by these Terms and Conditions as set forth in this agreement.

EXCLUSION OF LIABILITY

IN NO EVENT SHALL American Logo Watch, THEIR LICENSORS, SUPPLIERS OR ANY THIRD PARTIES MENTIONED ON THE WEBSITE BE LIABLE FOR ANY DAMAGES (INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, PUNITIVE, GENERAL, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, CLAIMS FOR PERSONAL INJURY, LOST PROFITS, OR DAMAGES RESULTING FROM THE DELAY, FAILURE, INTERRUPTION, OR CORRUPTION OF ANY PRODUCTS OR DUE TO ANY BUSINESS INTERRUPTION) ARISING OUT OF OR IN ANY WAY CONNECTED WITH YOUR USE OF OR INABILITY TO USE OUR WATCHES, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, AND WHETHER OR NOT American Logo Watch IS ADVISED OF SUCH DAMAGES.

COPYRIGHT, TRADEMARK AND OTHER PROPRIETARY RIGHTS

The Content consists of copyrighted works proprietary to American Logo Watch and/or its licensors or suppliers. You may download and print a single copy of the Content solely for your personal, non-commercial use. Any Content you download or print may not be altered in any way and must contain the following copyrighted notice: “Copyright © 2022 American Logo Watch. All Rights Reserved.” Any other use of the content on our site, social media, or our products is expressly prohibited without our prior written permission and any rights or licenses to any tangible or intangible American Logo Watch materials not expressly granted herein are expressly reserved to American Logo Watch. Any unauthorized use of any of our products, pictures or any of the content created by American Logo Watch is a violation of law and subjects you to all civil and criminal penalties provided for under domestic and international laws covering such unauthorized use.

All watches and service names, logos and symbols used and displayed on our website are registered trademarks of American Logo Watch and others. Nothing on this website shall be construed as granting, by implication, estoppel or otherwise, any license or right to use any trademark displayed on this Website without the prior written permission of the trademark owner. American Logo Watch’s trademarks may not be used in connection with any product or service that is not associated or affiliated with American Logo Watch, in any manner that is likely to cause confusion among the public, or in any manner that disparages or discredits American Logo Watch or the trademark, without prior written consent from American Logo Watch.

POSTING

You agree that you will not post any communications or content of any type that infringe or violate any rights of any party. By submitting communications or content to any part of this website, you agree that such submission is non-confidential for all purposes. If you post such communications or content, you automatically grant—or warrant that the owner of such content has expressly granted American Logo Watch a royalty free, perpetual, irrevocable, world wide nonexclusive license to include the work on this website (and to use, reproduce, create derivative works from, modify, publish, edit, translate, distribute, perform and display the communication or content in any medium, or any form, format or forum now known or hereafter developed).

APPLICABLE LAW AND VENUE

By accessing this website, or purchasing any of our products, you and American Logo Watch agree that the statutes and laws of the State of California, without regard to conflicts of laws principles thereof, will apply to all matters arising from or relating to use of this website and/or any and all of our watches except where preempted by the federal laws of the United States of America, in which case such U.S. federal law will apply. 

SEVERABILITY

If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect.

SURVIVAL

The following provisions of these Terms and Conditions shall survive the expiration or termination of these Terms and Conditions: No Warranties, Exclusion of Liability, Applicable Law and Venue, Severability, Survival, Indemnification, Subscriber Agreement, and Complete Agreement.

WAIVER

Any waiver of any of these Terms and Conditions shall not operate or be construed as a continuing waiver of such term or condition or any other term or condition.

INDEMNIFICATION

In consideration of American Logo Watch allowing you to visit and use our website, you agree to defend, indemnify and hold harmless American Logo Watch and its divisions, subsidiaries, parents, affiliates, partners, chains, and its respective past, present and future officers, directors, stockholders, trustees, employees, agents, insurers, servants, managers, estates, predecessors and/or successors in interest, representatives, assigns, attorneys and all other persons, firms, or corporations with whom any of the forgoing may have been, are now, or may thereafter be affiliated (collectively “Releasees”), from any and all claims, charges, injuries (including, but not limited to), actions, causes of action, sums of money due, suits, debts, liens, covenants, contracts, obligations, costs, expenses, damages (including special, general, incidental, consequential, or other damages), judgments, agreements, promises, demands, claims for fees and costs, or liabilities whatsoever, in law or equity, arising out of or relating to your use (lawful or unlawful) of the website or the content, your breach of any of the Terms and Conditions set out herein, your use of any linked websites reached through this website, your inability to access the website for any reason, your reliance on any errors or omissions on the website. You agree to defend, indemnify and hold American Logo Watch and its divisions, subsidiaries, parents, affiliates, partners, chains, and its respective past, present and future officers, directors, employees, agents, licensors and suppliers, harmless from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from (1) your breach of these Terms and Conditions or (2) your unauthorized or unlawful use of this website, the content, or any of our products or services.

COMPLETE AGREEMENT

These Terms and Conditions contain the entire agreement between you and American Logo Watch relating to your use of American Logo Watch’s website (www.logo.americanwatch.com), our watches(including stock and custom, private labeled products), services (including graphic design work, which includes vectorizing logos and/or artwork that is provided to American Logo Watch. This includes any artwork or graphics in any form that is not ready for laser engraving.
